AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Dream TKY Trading LLC ("we," "us," "our"), concerning your access to and use of the bookedandbeautiful.site website as well as any related applications (the “Site” and collectively, the “Service”).

You agree that by accessing the Site and/or Service, you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. The Service

Booked & Beautiful is a Software-as-a-Service (SaaS) platform that provides beauty and wellness professionals ("Service Providers") with tools to manage their business, including appointment scheduling, client management, and payment processing. Clients ("Customers") can use the Service to find and book appointments with Service Providers.

2. Intellectual Property Rights

Unless otherwise indicated, the Site and Service are our proprietary property. This includes all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”). You are granted a limited, non-exclusive, non-sublicensable, and non-transferable license to access and use the Service for your personal or internal business purposes strictly in accordance with these Terms.

3. User Representations

By using the Service, you represent and warrant that:

• You have the legal capacity and agree to comply with these Terms.
• You are not a minor in the jurisdiction in which you reside.
• You will not use the Service for any illegal or unauthorized purpose.
• Your use of the Service will not violate any applicable law or regulation.

4. User Registrations

You may be required to register to access the Service. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. Prohibited Activities

You may not access or use the Service for any purpose other than that for which we make the Service available. Prohibited activities include, but are not limited to:

• Systematically retrieving data to create a collection or database.
• Tricking, defrauding, or misleading us and other users.
• Engaging in any automated use of the system, such as using scripts to send comments or messages.
• Interfering with, disrupting, or creating an undue burden on the Site or the networks connected to the Site.
• Attempting to impersonate another user or person.
• Using the Service for any obscene or immoral purpose.
• Harassing, annoying, intimidating, or threatening any of our employees or agents.
• Using the Service as part of any effort to compete with us.

6. Service Provider and Customer Responsibilities

• For Service Providers: You are solely responsible for the services you provide, your client interactions, setting your prices, and complying with all applicable laws and regulations for your business and region. You are the data controller for the client information you input into the Service.
• For Customers: Your relationship is directly with the Service Provider. We are not a party to any transactions between you and the Service Provider. We are not responsible for the quality, safety, or legality of the services provided. Disputes must be resolved directly with the Service Provider.

7. Fees and Payment

We use a third-party payment processor, Stripe, to bill you through a payment account linked to your account. You agree to pay all charges at the prices then in effect for your purchases, and you authorize us to charge your chosen payment provider via Stripe. We reserve the right to correct any errors or mistakes that Stripe makes even if it has already requested or received payment. All sales are final, and fees are non-refundable, except as required by law or as explicitly stated in our Refund Policy.

8. Cancellation and Termination

You can cancel your subscription at any time by logging into your account or contacting us. Upon cancellation, your subscription will remain active until the end of your current billing cycle. We reserve the right, in our sole discretion, to deny, suspend, or terminate your access to the Service for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

9. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Site or Service at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Service. We cannot guarantee the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance.

10. Governing Law

These Terms shall be governed by and defined following the laws of the State of Maryland, United States. Dream TKY Trading LLC and yourself irrevocably consent that the courts of Montgomery County, Maryland shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Terms.

11. Disclaimer

THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICE'S CONTENT.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE, OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, ARISING FROM YOUR USE OF THE SERVICE.
